Agreement
These Terms form an agreement between you and Hako Systems, Inc., the operator of Not Them (“Not Them,” “we,” “us,” or “our”). By purchasing, starting a trial, or using Not Them, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and able to enter a binding agreement.
The service
Not Them provides automated, AI-generated conversational support by text for a boundary you choose. It is not therapy, medical care, legal advice, crisis monitoring, or an emergency service. It does not diagnose you or another person, and it cannot determine what another person thinks or will do.
Subscriptions, trial, and renewal
We offer a weekly subscription charged when you enroll and a monthly subscription with a card-required seven-day free trial. The monthly charge begins when the trial ends. Unless you cancel before the next charge, your selected subscription automatically renews at the price and interval shown at checkout. You authorize us and Stripe to charge your payment method for each renewal and applicable taxes. We will send the trial and purchase notices described at checkout to the email you provide.
Cancellation
You may cancel before your next charge through the online billing portal or by texting CANCEL from your subscribed number. Texting STOP opts out of the product’s messaging channel and also prevents the next renewal. Cancellation stops future charges; unless we tell you otherwise, access continues through the end of the paid period or trial. Deleting a conversation or the Messages thread does not cancel a subscription.
Payments and refunds
Prices are shown in U.S. dollars unless checkout says otherwise. Stripe processes payment information under its own terms and privacy policy. Except where required by law or expressly stated at checkout, charges already made are nonrefundable. If you believe a charge is incorrect, contact us promptly at support@textnotthem.com.
Messaging
Checkout does not automatically send a text. After checkout, you can open Messages and send the first prefilled text to activate the conversation. By sending it, you request conversational and service replies at that number. Message and data rates may apply, and message frequency varies. Reply STOP to opt out or HELP for help. Consent to receive messages is not a condition of purchasing another product or service.
Responsible use
Do not use Not Them to harass, threaten, impersonate, monitor, or facilitate unwanted contact with another person. Do not submit content you do not have the right to share, attempt to disrupt the service, evade rate or access limits, reverse engineer the service, or use it for unlawful activity. We may limit or end access when reasonably necessary to protect users, the service, or others.
AI limitations and emergencies
AI-generated replies can be incomplete, inappropriate, or wrong. You remain responsible for your decisions and for evaluating any response before acting on it. Not Them is not monitored as an emergency service. If you or someone else may be in immediate danger, contact local emergency services or an appropriate crisis resource.
Availability and changes
We may modify, suspend, or discontinue features and may impose reasonable usage limits. Message delivery and the service may be delayed or unavailable. We may update these Terms by posting a revised version and updating the date above. If a material change affects an active subscription, we will provide notice as required by law.
Disclaimers and liability
To the fullest extent permitted by law, Not Them is provided “as is” and “as available,” without warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted operation. To the fullest extent permitted by law, Not Them and its operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or opportunities. Our total liability arising from the service will not exceed the greater of $100 or the amount you paid to Not Them during the six months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so these limits apply only to the extent permitted by law.
General
If part of these Terms is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a merger, financing, reorganization, or sale of the service. Applicable law governs these Terms without overriding consumer protections that apply where you live.
